Can I Claim for a Road Accident if It Was My Fault?

Can I claim for an accident that was my fault?

In order to make a claim for a road accident – whether you were in a car, on a bicycle or motorcycle, or you were a pedestrian – you’ll need to show that you were not the person responsible for what happened. So it won’t be possible to make a claim if you were entirely at fault for your road accident.

But there are some situations where you may be able to make a claim even if your actions contributed to the crash.

You will usually be able to claim compensation if you have been injured in an accident that was caused by someone else’s negligence. This means that if someone else contributed to your accident – and you were not the only person responsible – you could still be able to make a road traffic accident claim.

How much can I claim for an accident that was partly my fault?

If you were partly to blame for an accident, the matter of responsibility will affect how much compensation you are ultimately awarded.

Your liability will affect how much compensation you will receive. For example, if it’s found that you were 30% to blame for a road accident, you will receive 30% less compensation for a successful claim. The other party will usually also be able to claim compensation on that same basis.

Any compensation you are awarded will be split into general damages and special damages. General damages will compensate you for the pain and suffering you’ve experienced because of your accident.

Meanwhile, special damages will cover any financial impact your injury has had. This includes a loss of earnings if you can’t work, medical expenses and any damaged property.

How do I know who was responsible for my accident?

It’s not always immediately obvious who has caused an accident. This is more likely to happen when there are multiple people and vehicles involved in a collision.
