How much compensation could I get for a neck injury?

Where will my neck injury compensation payout come from?

If your claim is successful, the circumstances surrounding your injuries will determine who is responsible for paying your compensation.

One of the most common causes of neck injuries is road traffic accidents. In these instances, your compensation will be paid through the other driver’s insurance company.

If the driver who caused your injuries cannot be traced or was not insured, you’ll receive a settlement through the Motor Insurers’ Bureau instead – a body that was set up to help people who are involved in collisions with uninsured or hit-and-run drivers.

Neck injuries are also common in the workplace. In these cases, compensation is paid through an employer’s insurer. Companies are required by law to have liability insurance in place to cover the cost of potential claims, so you won’t be leaving anyone out of pocket by taking legal action.

We know it can be daunting to think about making a claim against your employer. But there are laws in place to protect you. Although we cannot guarantee that your employer won’t dismiss you, they would be risking an unfair dismissal case if they did.

Is there a limit on when I can make a neck injury claim?

Usually there will be a three-year time limit on when you can make a neck injury claim. This will typically start from the date of your accident.

But there are some exceptions to this rule. For example, if you’re claiming on behalf of a child, you will have until their 18th birthday to make a claim. If you decide not to bring a claim during this time, they will have until they’re 21 to make a case for compensation.

Similarly, if you’re making a claim on behalf of someone who is lacking mental capacity, you won’t be subject to the three-year time limit. Instead, you’ll have an unlimited amount of time to bring forward a claim as a litigation friend.
