Can you get compensation for pleural thickening?

Pleural thickening is one of the most commonly diagnosed conditions related to asbestos exposure. It occurs when scar tissue develops along the lining of one or both lungs, causing it to thicken.

As with most asbestos-related illnesses, pleural thickening is often developed as a result of working in close contact with the toxic fibres. Some of the most commonly affected industries include:

  • Building and construction
  • Industrial and factory work
  • Mining
  • Plumbing
  • Ship building

If you’ve been diagnosed with pleural thickening after being dangerously exposed to asbestos in the past, you could have a case for compensation.

Our friendly claims advisors are here to listen to the details of your situation and let you know if you have a strong claim. Get in touch for a free no obligation consultation to find out more.

Why make a pleural thickening claim?

Getting a diagnosis of pleural thickening can be incredibly overwhelming. Even if you were already aware that you had been exposed to asbestos, having your worries confirmed can still come as a shock.

We understand that there will be a lot going through your mind, and making a claim may not be your first priority. But although claiming compensation won’t reverse what happened, it could help you to manage your condition going forward.

For instance, you may have concerns about how you’ll pay for further medical treatment, mobility aids or additional care. This will all be factored into any compensation you receive, so you can focus your energy on things like spending time with family and friends.

How can First4Lawyers help?

These types of claims can become complicated due to the nature of asbestos-related conditions. Often, it won’t be until decades after an initial exposure to asbestos that the signs of pleural thickening appear.

This means that the company responsible for exposing you to asbestos may no longer be in operation. But an experienced industrial disease solicitor can help you to find your former employer’s insurer and bring a claim through them, instead.

Our solicitors have years of combined experience in this area, so you can feel confident that you have an expert at your side.

For pleural thickening claims, we offer a No Win No Fee service. So if you decide to make a claim with us, there will be nothing to pay up front and no legal fees to cover if your case is unsuccessful.

Only pay a fee if you receive compensation

Our No Win No Fee solicitors will take a success fee from the compensation you are awarded for a successful claim in the form of a percentage of your damages. This could be up to 25% but it won't be more than that, except in cases of road traffic accidents. Changing laws mean our solicitors will now take a payment of 30% of the final compensation amount plus VAT for all road traffic accident claims.

First4Lawyers are an award-winning claims management company with a track record of delivering service that our clients love.

Pleural thickening claim FAQs

Can I make a pleural thickening claim for someone who has died?

We know that sadly it is not always possible for an individual with pleural thickening to bring their own claim. If someone close to you has passed away due to pleural thickening, you could bring a claim on their behalf.

Nothing will make up for the loss of your loved one, but making a claim could help to bring a sense of justice and closure. It could also help you financially if you were a dependant of the person who has died.

To make a claim on behalf of someone who has passed away, you will usually need to fall into one of these groups:

If you’re not sure whether you can make a claim for a loved one, get in touch with our friendly and compassionate team. We’ll answer any questions you may have and let you know if we’re able to help.

How much compensation can I get for pleural thickening?

Compensation amounts for pleural thickening will depend on the level of respiratory disability you have, as well as the future risk to your health and life expectancy.

Your settlement will also consider whether this is a provisional or final payment. A provisional payment is where you receive a certain amount, with the understanding that you may make a further claim if you develop another asbestos-related illness.

Our legal experts will explain your options, so you can be sure you’re getting the most out of your claim.

How long do I have to make a pleural thickening claim?

As pleural thickening can take so long to develop, the time limit on these types of claims won’t start until you’re diagnosed. You’ll then have three years to start a claim.

We understand that you might be hesitant about starting legal action. You may be unsure about where you were exposed to asbestos, or perhaps the company responsible is no longer trading. But you shouldn’t let this put you off.

Our solicitors will use their experience and knowledge to identify when and where you were exposed, before reaching out on your behalf to negotiate a settlement.

If you’re making a claim for someone who has passed away, you will have three years from the date of their death to bring a claim. The only exception to this is if your loved one passed away more than three years after being diagnosed. In these cases, the court will need to give permission for a claim to go ahead.

Part of a solicitor’s role is to advise you of your options while making sure all the relevant deadlines are met for your claim. We would always suggest seeking legal advice as early as you can, so you can work out where you stand.
