What is a spinal surgery claim?

Spinal surgery is intended to reduce or completely eliminate the amount of back pain you suffer with.

There are a number of different types of spinal surgery, including spinal fusion surgery, discectomy, disc replacement surgery and laminectomy. The majority of these surgeries go ahead without any problems. But things don't always go to plan.

Examples of spinal surgery negligence include:

If you’ve had spinal surgery that went wrong due to a clinician’s negligence and caused you pain as a result, you are entitled to justice.

Why should I make a spinal surgery claim?

Spinal surgery can be a major procedure to go through. You’ll be hopeful that it will end the pain you’ve been in for a long period. Then you emerge, only to find that something went wrong and you’ve been the victim of medical negligence.

If you’ve been left worse off after spinal surgery, you could make a claim for compensation. However, one of the most significant benefits of proceeding with a claim is that you give the hospital the opportunity to address what went wrong. This can help those in charge work to stop it happening to anyone else in the future.

Is there a time limit for spinal surgery claims?

In most cases of spinal surgery claims, you’ll face a time limit of three years. You should make sure you start the process as soon as possible to get your claim submitted before the deadline.

There are some exceptions to the medical negligence claims time limit, though. Children can make a claim at any point until their 18th birthday. After that, the three-year time limit will begin, meaning they have up to their 21st birthday to make a claim.

If you’re claiming on behalf of someone who lacks the mental capacity to claim for themselves, you won’t face a time limit unless they regain capacity. If they are not expected to regain capacity, you won’t face a time limit.

How much compensation will I receive?

Every spinal surgery claim is different. This means it is difficult to say exactly what you could be entitled to without a consultation.

However, for a rough idea of what you may be awarded, see our compensation calculator.
