What is a failed sterilisation claim?

If you have decided to undergo a sterilisation – for medical reasons or because you feel your family is complete – the very least you expect is for the procedure to work. So if it doesn’t or it causes you harm, you could be left feeling distressed.

This could leave you dealing with an unplanned pregnancy, and the resulting consequences on your physical and mental health.

If this has happened to you and was caused by your healthcare provider’s negligence, you could be able to make a claim for compensation. This could go some way towards helping you recover from the shock of the experience.

However, sterilisation is not a guaranteed form of contraception. In some cases, even after a successful sterilisation, the fallopian tubes or sperm duct can regrow naturally. This means you will no longer be sterile and could face an unwanted pregnancy. However, it can’t be considered medical negligence as it was a natural occurrence.

Why should I make a failed sterilisation claim?

If you find that you are pregnant despite having undergone a sterilisation procedure, you may decide to continue the pregnancy. However, you may find that you struggle financially as you were not planning on having a baby.

Is there a time limit for making a failed sterilisation claim?

In most cases, you will have three years to make your claim. However, as you will usually only realise your sterilisation procedure has failed when you find out you – or your partner – are pregnant, you will typically have three years from the date you found out you were pregnant to make a claim.

How much compensation will I receive for making a failed sterilisation claim?

Successful unwanted pregnancy claims typically see compensation of around £15,000. This is awarded for the infringement of your right to limit your family size. You could also likely see £5,000 in compensation for the pain and suffering of pregnancy and labour.
