Making an Essure sterilisation coil claim

Women who have had an Essure sterilisation coil implanted have reported suffering from illness and pain as a result.

Manufactured by Bayer, the device prevents pregnancies by causing scarring to build up in the fallopian tubes. But a large number of women who have had the coil fitted have reported serious complications.

The company has already set aside £1.2 billion to settle claims from around 40,000 US women.

Among the symptoms suffered by women who had the Essure device fitted are:

  • Back pain
  • Irregular and heavy periods
  • Fatigue
  • Hair loss
  • Migraines
  • Pain during sex
  • Perforation of the uterus or fallopian tubes due to the coil moving in the body

A 2015 study published in the BMJ found that women who had the Essure coil fitted were 10 times more likely to need a further operation than women who underwent other forms of sterilisation.

If you have been affected by the Essure coil – including having a hysterectomy – you could be able to make a medical negligence claim for compensation.

Why should I make an Essure coil claim?

If you’ve had an Essure coil fitted, you might be feeling let down by your doctors – the people who should have helped you have caused you unnecessary pain.

You are entitled to justice when you’ve been hurt through no fault of your own. You’ve experienced a breach of trust that you couldn’t have predicted. You deserve to have this acknowledged.

You may also have had to take time off work as a result of the symptoms you’ve experienced. That could have left you facing financial difficulties. Making a compensation claim could give you some breathing space to let you focus on your recovery, rather than worrying about paying your bills.

How much compensation will I receive?

Each medical negligence claim is different. Your situation – including your symptoms and their severity – may be different to someone else suffering from the same problem. That makes it difficult to say exactly what you might be entitled to without having an initial conversation with our team.

Our compensation calculator could help give you a rough idea for what you could be awarded for certain injuries or illnesses. You can also feel free to give our friendly and compassionate team a call and have a chat about your circumstances – for free and with no obligation.

The amount you receive for a successful claim will include compensation for a number of factors, including:

  • Any care you’ve needed
  • Changes to your lifestyle, such as being unable to take part in your usual hobbies
  • Loss of earnings
  • Medical expenses
  • Mobility aids
  • The pain and suffering you’ve experienced

How long do I have to make a claim?

When you decide you want to go ahead with a claim, it’s important to remember that you’ll usually face a deadline to do so.

In most cases, you’ll have three years to make a claim. This starts from the date you had the Essure coil fitted. But in cases like these, you probably won’t have realised immediately that the operation was what caused your symptoms. In fact, you may not have developed symptoms until a while after having the coil fitted.

When this happens, you’ll usually have three years from the date you learnt the Essure coil was responsible for your illness. This is known as the date of knowledge.

If you’re not sure whether you can make a claim, just get in touch. Our advisors will be happy to clear this up and set out your options, helping you decide on the best next step.

How can I fund my Essure claim?

Taking legal action is often seen as something only the wealthy can afford. You may worry that you won’t be able to pursue legal action because of the cost of legal fees.

But in the case of many childbirth and gynaecology negligence claims, you won’t have to worry about this. Most of the claims that we process are done on a No Win No Fee basis.

This means that you won’t have to worry about any upfront costs, leaving you to focus on yourself.  There is also nothing to pay if your claim is unsuccessful. This makes it risk-free.

Instead of worrying about your finances and the potential impact that making a claim might have, you can take the time to help your recovery and to put together the strongest case possible.

Only pay a fee if you receive compensation

Our No Win No Fee solicitors will take a success fee from the compensation you are awarded for a successful claim in the form of a percentage of your damages. This could be up to 25% but it won't be more than that, except in cases of road traffic accidents. Changing laws mean our solicitors will now take a payment of 30% of the final compensation amount plus VAT for all road traffic accident claims.

First4Lawyers are an award-winning claims management company with a track record of delivering service that our clients love.

What evidence will I need?

One of the most important pieces of evidence in a medical claim is your medical history. Your solicitor will request access to your healthcare records to show how you have been impacted by having the Essure device fitted.

They will also usually arrange for you to be assessed by a medical professional, who will then put together a report on how seriously you’ve been affected and how long your recovery is likely to be. Your solicitor will use this to put together their case.

You could also help by providing a symptom diary, detailing the symptoms you’ve suffered from and when they began.

Witness statements can also be important evidence in medical claims. You can help your solicitor by putting together a list of anyone who was involved in your procedure and recovery and their contact details.

It’s always hugely important to work with your solicitor during a compensation claim. Make sure you’re responding to their requests and queries as quickly as possible. This can help to keep the time it takes to conclude your case to a minimum.
