There were 6.83 billion passenger journeys in 2017/18, according to the Department of Transport. And that doesn’t include journeys by air, taxi or lifts from family and friends.

When can you make a passenger injury claim?

If you were injured while a passenger in a vehicle, did you know you could have the right to claim?

Drivers have a legal obligation to ensure your safety when you are a passenger in their vehicle – whether they are a bus driver, taxi driver, tram driver or a friend.

For example, if a child under the age of 14 is injured and they weren’t wearing a seat belt, the driver is responsible as they didn’t ensure the child’s safety.

If the person driving was at fault, or the driver of another vehicle if it was a collision, you could claim from their insurer.

What if the driver has no insurance?

If the driver responsible for your accident was driving without insurance, you can still make a claim.

The Motor Insurers’ Bureau (MIB) helps with accidents where you are unable to claim from the insurer of the driver at fault, such as where there is no insurance and where a driver leaves the scene of an accident.

Claiming against a friend or family member

People can be understandably worried if the driver at fault is a friend or member of your family.  However, a compensation claim will be paid by the insurer, so it doesn’t come straight out of a loved one’s pocket!

You must make a claim within three years of the accident taking place.

Make sure you get medical attention promptly and tell them about the accident so that it’s added to your medical records.

Photographic evidence is useful if you have it, as well as the insurance details of the person at fault.  If there were any witnesses, or fellow passengers, their statements would also be very helpful.

Many people nowadays use dash cams, providing a valuable source of evidence when making a claim.

If you were a passenger in a taxi, try to gather details such as the cab firm, driver’s name and number.
