Amputation and limb loss claims

Losing a limb through accident or amputation is a devastating prospect for anyone to face, especially if it is the result of a preventable injury or accident. Recovery will include a period of adjustment, where you learn to live with your injury, and making a compensation claim may just make that transition easier.

Between 2015 and 2018, 27,465 amputations were carried out in England. Amputations can be carried out after various accidents, such as road traffic accidents, or healthcare problems, including medical negligence.

Types of amputation or limb loss

There are many types of amputation, including:

  • Leg amputation – below, through or above the knee
  • Foot amputation, including toes
  • Hands and fingers or thumb amputation
  • Arms – at the elbow, above the elbow or at the shoulder

Why should I make a claim?

It's hard to think about anything other than what you have been through, but the truth is if your ordeal is the result of someone else's negligence, then they should be held accountable.

A compensation amount can help pay towards your medical costs, therapy for the psychological effects of amputation, treatment and prosthetics.

It can also ease the financial burden of any alterations you need to make to your home or vehicle, to aid your rehabilitation and keep you mobile. There is also time off work and loss of earnings to consider.

How much compensation could I receive?

Lost limbs compensation amounts can vary greatly, depending on the case.

Our Compensation Calculator can give you an idea of current damages recommended by the Judicial College Guidelines.

To give you an idea, loss of a leg with amputation above the knee can see awards of £91,910 to £120,530, while the loss of a thumb could see awards from £31,140 to £48,080.

Is there a time limit for making an amputation claim?

Most claims for amputation or loss of limbs need to be made within three years of the accident or injury, but there are some exceptions.

For example, a child amputee will have three years starting from their 18th birthday. If a person's mental capacity is diminished and they are unable to make their own decisions, then there is no time limit.

Our specialist advisers will be able to explain it all to you in a clear, no-jargon manner, based on your individual circumstances.
